Terms and Conditions of Service (Repair and Technical Service Agreement)

1. Service Evaluation and Pricing
1.1. The cost of services is determined after diagnostic evaluation of the device or equipment.
1.2. Any preliminary estimate is approximate and may change following actual inspection.
1.3. Work will begin only after the estimate has been approved by the Customer.
1.4. If the repair cost does not exceed CAD 100 and prior authorization has been provided by the Customer, the repair may be completed immediately without additional approval.

2. Payment Terms
2.1. Payment for repair services is due upon completion of the work unless otherwise agreed in writing.
2.2. The Service Provider reserves the right to require a deposit before commencing repair work.
2.3. Payment for diagnostic services is due upon return of the device.
2.4. The device may be retained until full payment for services has been received, in accordance with the laws of the Province of New Brunswick.

3. Warranty
3.1. Warranty applies only to parts installed and services performed by the Service Provider.
3.2. The warranty is void if the device has been used in violation of the manufacturer’s recommended operating conditions.
3.3. The warranty does not cover:
* physical damage,
* liquid damage,
* power surges,
* improper use,
* repairs or modifications performed by third parties.
3.4. The warranty period, if applicable, will be specified on the invoice or service report.

4. Customer Responsibilities
4.1. The Customer is responsible for backing up all data prior to submitting the device for service.
4.2. The Service Provider is not responsible for loss of data, software, or information during diagnostics or repair.
4.3. The Customer must inspect the completed work at the time of device pickup.

5. Software Installation
5.1. Software installation will be performed only using legally licensed software provided by the Customer or purchased with the Customer’s approval.

6. Limitation of Liability
6.1. The Service Provider’s liability is limited to the amount paid for the specific service performed.
6.2. The Service Provider shall not be liable for indirect or consequential damages, including loss of profit, business interruption, or data loss.

7. Non-Warranty Situations
7.1. Warranty obligations are void if the equipment configuration is modified after completion of the repair.
7.2. The warranty does not apply to failures resulting from normal wear and tear, operating conditions, or external factors.

8. Parts and Materials
8.1. Installed parts and used materials are non-refundable once installed unless found to be defective under warranty.

9. Storage and Unclaimed Equipment
9.1. The Customer must schedule a date and time to collect the device within 10 days after notification of repair completion.
9.2. Storage fees may apply after this period.
9.3. Devices not collected within 6 months may be considered abandoned in accordance with the laws of the Province of New Brunswick. The Service Provider reserves the right to recover repair and storage costs through sale or disposal of the device where permitted by law.

10. Accessories
10.1. Devices must be submitted without accessories unless required for diagnostics.
10.2. The Service Provider is not responsible for accessories not listed on the service intake receipt.

11. Acceptance of Terms
11.1. By submitting a device for repair, the Customer confirms acceptance of these Terms and Conditions.
11.2. The Customer accepts and agrees to these Terms and Conditions by selecting the option “I have read and agree to the Public Contract” when creating a service request in the Book Your Service section on the website maritimegadgetclinic.ca.
